Terms of Service

1. Acceptance of terms

By downloading, installing, or using GymPulseTimer (the “Apps”) or accessing gympulsetimer.com (the “Site”), you accept these Terms of Service (the “Terms”) and our Privacy Policy. If you are using the Apps on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms.

2. License to use the Apps

Subject to your compliance with these Terms, Daniel Ancuta (trading as w3b, Brașov, Romania — the “Provider”) grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the Apps on devices that you own or control, for your personal, non-commercial use.

All intellectual property rights in the Apps, the Site, the GymPulseTimer name, the GymPulseTimer logo, and all related content remain the property of the Provider. Nothing in these Terms transfers any of those rights to you.

3. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code of the Apps, except to the extent the law permits notwithstanding this restriction
• Resell, rent, lease, sublicense, or otherwise commercialise the Apps
• Use the Apps or the Site to send spam, malware, or automated abuse against our infrastructure or third parties
• Circumvent rate limiting or other technical protections on the Site’s contact and notify-me endpoints
• Use the Apps or the Site in any way that violates applicable law or third-party rights

4. Accounts

GymPulseTimer does not require an account. There is no sign-up, no sign-in, and no password. The free tier and the one-time GymPulse Pro purchase are tied to the platform account (Apple ID or Google account) on the device.

5. In-app purchases and refunds

GymPulseTimer is free to download and use. The optional GymPulse Pro upgrade is a one-time, non-subscription in-app purchase processed by Apple (iOS) or Google (Android). Pricing is shown in the App before purchase and may vary by region and platform fees.

Refund requests are handled by Apple or Google through the platform’s standard refund process — we do not have the ability to issue refunds directly. We will of course help you troubleshoot any entitlement issue: email support@gympulsetimer.com.

6. Health and fitness disclaimer

GymPulseTimer is a workout-interval timer. It is not a medical device, does not provide medical advice, and is not a substitute for professional fitness, medical, or physiotherapy guidance.

Consult a qualified healthcare professional before starting any new exercise programme, especially if you are pregnant, recovering from injury, or managing a chronic condition. You assume all responsibility and risk for any activity you perform while using the Apps. Stop immediately if you experience pain, dizziness, or any other concerning symptom.

7. Third-party services

The Apps and the Site rely on third-party services including but not limited to Apple, Google, TelemetryDeck, RevenueCat, Resend, Vercel, and (with your consent on the Site) Google Analytics and Microsoft Clarity. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or content of any third-party service.

8. User submissions

Anything you send us through the contact form, the Android notify-me form, or directly by email may be used to diagnose your issue, improve the product, and respond to you. We do not publish your messages or share them with third parties. See our Privacy Policy for retention details.

9. Disclaimer of warranties

The Apps and the Site are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, the Provider disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Apps or the Site will be uninterrupted, error-free, or free of harmful components.

10. Limitation of liability

To the maximum extent permitted by applicable law, the Provider will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Apps or the Site. The Provider’s aggregate liability for direct damages will not exceed the amount you paid for the GymPulse Pro upgrade in the twelve months preceding the event giving rise to the claim, or, if you have not made such a purchase, ten euros (€10).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under Romanian or European Union consumer law, including statutory consumer rights.

11. Indemnification

You agree to indemnify and hold harmless the Provider from any claim, demand, loss, or expense (including reasonable legal fees) arising from your misuse of the Apps or the Site, your violation of these Terms, or your infringement of any third-party right.

12. Termination

You may stop using the Apps and the Site at any time by uninstalling them and closing the browser tab. We may suspend or terminate access (including by blocking specific IP addresses on the Site) if we reasonably believe you are violating these Terms. Sections 2 (intellectual property), 9, 10, 11, 13, and 14 survive termination.

13. Governing law and jurisdiction

These Terms are governed by the laws of Romania, excluding its conflict-of-law rules. Any dispute arising under or in connection with these Terms will be brought before the competent courts of Brașov, Romania, unless mandatory consumer-protection law requires otherwise.

14. Changes to these Terms

We may update these Terms from time to time. The “Effective date” at the top of this page will always reflect the most recent revision. Material changes will be summarised in the changelog of our app release notes. Continued use after a change constitutes acceptance of the revised Terms.
